These Terms of Service ("Terms") govern your use of the BlogCog website and services. By accessing, using, creating an account, placing an order, or purchasing a subscription, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. Overview

BlogCog provides AI-powered blogging services. By using our platform, you agree to these Terms, which may be updated periodically. Continued use of our services constitutes acceptance of these updates.

2. User Eligibility

  • You must be at least 18 years old to use our services.
  • If you are using BlogCog on behalf of a company or organization, you represent that you have the authority to accept these Terms on its behalf.
  • You agree to provide accurate account and payment information.

3. Content and Liability

  • Image Rights: You confirm that all images provided for use in your blogs are either owned by you or used with appropriate rights or permissions. BlogCog is not responsible for verifying the rights or permissions associated with user-submitted images.
  • Special Instructions: You affirm that any special instructions provided for blog generation do not encourage plagiarism, infringe on intellectual property rights, or pertain to illegal or illicit subjects.
  • Editing and Deletion: You retain full control to edit or delete any published blogs on your website.
  • Ownership of Generated Content: Users retain full ownership of the content generated through BlogCog’s services. BlogCog does not claim intellectual property rights over any content produced for users.
  • Accuracy of Content: While BlogCog’s AI is designed to generate accurate and SEO-optimized content, we cannot guarantee the completeness, accuracy, or legality of the generated blogs. Users are responsible for reviewing the content after publication and making any necessary edits or removals. As the blogs are hosted on the user's website, users retain full control and may edit, modify, or delete the blogs at their discretion.
  • AI Hallucinations: Users acknowledge that AI-generated content may contain factual errors, omissions, or fabrications (commonly referred to as "hallucinations"). BlogCog makes no guarantees regarding the accuracy, reliability, or truthfulness of such content. Users are solely responsible for reviewing, editing, and verifying all generated content before publishing or relying on it.
  • Content Moderation: BlogCog reserves the right to refuse AI generation requests that violate these Terms or applicable laws. However, as BlogCog does not host the final content, users are responsible for reviewing, modifying, or removing any published content as needed.
  • Automatic Blog and Image Generation: To help users maintain a consistent publishing schedule and maximize SEO benefits, BlogCog may automatically generate and publish blog topics, posts, and/or AI-generated images when a user’s content queue is running low. These automatically generated items are intended as a convenience and value-added feature of the service. Users retain full ownership and control over all such content, and may edit or delete these items at their discretion. BlogCog makes no guarantees as to the accuracy, reliability, or suitability of automatically generated content, and users remain responsible for any content published on their websites.
  • Liability Waiver: BlogCog disclaims liability for any errors, omissions, or legal issues resulting from the use of generated content. Users assume full responsibility for the consequences of publishing the content. BlogCog's liability is limited to the amount paid for services within the past six months.
  • Indemnification: Users agree to indemnify, defend, and hold harmless BlogCog, its affiliates, officers, and employees from any claims, damages, liabilities, or expenses arising from user-provided content, misuse of services, API misuse, data breaches, or violations of these Terms.

4. API Access and Data Handling

  • Users granting API access acknowledge that BlogCog controls all API interactions and that they cannot directly modify or override API settings. Any unauthorized attempts to alter API access will result in account suspension.
  • Upon cancellation, BlogCog will remove stored API credentials and queued blog entries within 30 days, unless required to retain them for legal or operational reasons.
  • BlogCog disclaims liability for third-party system outages, API changes, or disruptions beyond its control.

5. Subscription and Billing

  • Subscription plans are billed monthly, with charges based on the selected publishing frequency.
  • Setup fees for special features are non-refundable.
  • Subscriptions renew automatically unless canceled at least 48 hours before the next billing cycle.
  • BlogCog reserves the right to modify subscription fees, provided that users are notified at least 30 days in advance of any price increases.
  • Trials, Promotions, and Free Services: Any free trials, promotional services, complimentary accounts, or free add-ons (including blogs or sites provided without charge) are offered at BlogCog’s discretion. All such services remain subject to these Terms of Service, including the disclaimers of accuracy, liability, and indemnification. BlogCog reserves the right to modify, limit, or terminate free or promotional services at any time without notice. Users remain responsible for reviewing and managing any content generated through these services.

6. Cancellations and Refunds

  • You may cancel your subscription at any time via your account dashboard or by contacting info@blogcog.com.
  • Refunds are not provided for partially unused subscription periods.
  • Disputes regarding billing must be raised within 30 days of the charge date.

7. SMS Communication

By providing your phone number and opting into SMS communication, you consent to receive marketing messages, order updates, and other notifications from BlogCog. You may receive up to 5 messages per month, depending on your account activity. Message and data rates may apply.

You can opt out of SMS communication at any time by replying "STOP" to any text message you receive from us. Opt-out requests will be confirmed via SMS. For assistance, reply "HELP" or contact us at info@blogcog.com.

8. Prohibited Use

  • Do not use our platform for illegal, harmful, or abusive purposes.
  • Do not attempt to bypass or breach the security of our website or services.
  • Do not engage in spamming, fraudulent activities, or introduce malicious code (e.g., viruses).
  • Users may not use BlogCog to create or distribute hate speech, harassment, or discriminatory content.

9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Florida. Any disputes shall be resolved through binding arbitration in Florida, in accordance with the rules of the American Arbitration Association (AAA). Each party will bear its own costs unless otherwise awarded by the arbitrator.

Users waive the right to participate in class actions or class arbitrations.

Users may bring claims in small claims court in their jurisdiction if permitted by law.

10. Force Majeure

BlogCog shall not be held liable for delays or failures caused by events beyond its reasonable control, including acts of God, natural disasters, network interruptions, pandemics, cyberattacks, government actions, or regulatory changes.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be communicated at least 14 days in advance via email or site notice. Your continued use of our services indicates acceptance of the updated Terms.
